OVERVIEW:

The CSA, together with the University of Sydney Law School, is delighted to welcome global Copyright Law authorities, Professor Jane C. Ginsburg (Columbia University Law School and Percy Spender Fellow, University of Sydney Law School) and The Hon. Justice Nye Perram (Federal Court of Australia).

Professor Ginsburg and Justice Perram will address the impact of recent cases concerning transformative uses of copyright protected material, including the Supreme Court of the United States decisions in ANDY WARHOL FOUNDATION FOR THE VISUAL ARTS, INC. v. GOLDSMITH ET AL and GOOGLE LLC v. ORACLE AMERICA, INC.

In its 2023 finding against the Andy Warhol Foundation, the US Supreme Court shifted the consideration away from the artistic contribution of the new work, and focused instead on the commercial implications of the copying, as required by the fourth factor of the Fair Use defence under §107 of the US Copyright Act.

Commentators have suggested the decision “will significantly limit the amount of borrowing from and building on previous works that artists can engage in.”

This special event will explore the limits of transformative uses of copyright works in Australia and international jurisdictions.

Jane C. Ginsburg, BA, MA University of Chicago; JD Harvard; DEA, Doctorat en droit Université de Paris Panthéon-Assas; Doctorate honoris causa University of Neuchâtel, Switzerland, is the Morton L. Janklow Professor ofLiterary and Artistic Property Law at Columbia University School of Law, and Faculty Co-Director of its Kernochan Center for Law, Media and the Arts. She teaches Copyright Law, International Copyright Law, Trademarks Law, Legal Methods, and Statutory Interpretation, and is an author of casebooks in all five subjects, as well as of many books, articles and book chapters on domestic and international copyright and trademark law. She is a Corresponding Fellow of the British Academy, and Member of the American Philosophical Society and the American Academy of Arts and Sciences, and an Honorary Fellow of Emmanuel College, Cambridge.

THE HON. JUSTICE NYE PERRAM

The Honourable Justice Nye Perram was appointed to the Federal Court on 8 August 2008. His Honour graduated from the University of Sydney with a Bachelor of Arts and a Bachelor of Laws and from the University of Oxford with a Bachelor of Civil Law. He practised as a barrister in New South Wales from 1993 and was appointed senior counsel in 2006. At the time of his appointment he was a member of the Law and Justice Foundation and the New South Wales Bar Council. His Honour has also been a part-time Commissioner of the Australian Law Reform Commission. Justice Perram currently serves as the President of the Copyright Tribunal of Australia and is the Chair of the Federal Court’s Digital Practice Committee.
