Seminar: 24 July 2008: Appeal decision in Channel Nine v Ice TV

On 9 May, a Full Court of the Federal Court allowed an appeal by Nine Network Australia Pty Ltd of the decision concerning the reproduction of weekly tv guides by IceTV Ltd.
Nine Network claimed that its weekly television program schedules were protected by copyright as compilations and that IceTV had reproduced a substantial part of the schedules in its own electronic program guide, the IceGuide.
The Full Court unanimously held that IceTV had appropriated the labour and skill used to create Nine’s compilations by indirectly copying a substantial part of them.
